Main Functions of Offshore Capital Market Registry (OCMR China)

In accordance with the relevant laws and regulations, Offshore Capital Market Registry (OCMR China) undertakes the following obligations in the oversight and guidance of the markets:

  1. Research and develop policies and development plans for the securities, asset management and futures markets; draft the appropriate laws and regulations on the securities, asset management and futures markets as well as provide opinion for establishment or amendment of the laws and policies; and to construct the pertinent rules, regulations and actions for the securities, asset management and futures market.
  2. Apply policy over the securities, asset management and futures administrative organizations and conduct oversight of the securities, asset management and futures market; and maintain effective control of the management of the relevant securities companies.
  3. Monitor the market behavior of companies and their shareholders to ensure compliance with the relevant obligations according to the relevant laws and regulations.
  4. Oversee the trading and settlement of futures and monitor the non-domestic futures business of local organizations in accordance with the regulations.
  5. Oversee the securities, asset management and futures markets as well as upper management in conformance with the regulations in the capacity of a competent executive.
  6. Oversee the direct or indirect issuance and listing of shares overseas by local companies as well as the listing of convertible bonds by the companies listed non-domestically; supervise the formation of asset management ,securities and futures organizations outside of China by domestic asset management, securities and futures business organizations; and oversee the formation of asset management, securities and futures organizations in China by overseas organizations for asset management , securities and futures businesses.
  7. Oversee the communication of asset management, securities and futures information; and command of the management of the statistical and informational capital for the asset management, securities and futures markets.
  8. Examine and punish activities in contravention of the asset management, securities and futures laws and regulations.
  9. Supervise the forex and international collaborative affairs of the asset management, securities and futures sector in the capacity of a competent executive.
  10. Perform other duties as assigned by the State Council.
